Critical analysis of international protection of the right to protest criminalized. Case of Chile 2011-2019

In the context of protests, human rights become a crucial issue that reveals the intersection between citizen expression and the protection of fundamental freedoms; demonstrations, whether peaceful or agitated, serve as vehicles for the articulation of social and political demands. The objective of this research is to critically analyze the international protection of the right to protest against its criminalization, taking as a case study the protests in Chile between 2011 and 2019. A qualitative method based on documentary analysis of international and national sources was employed. The results show that, although protest is recognized as a fundamental right, its practical effectiveness depends on the state’s willingness to comply with recommendations; in Chile, excessive use of force, arbitrary detentions, and media stigmatization were evident. The discussion concludes that international protection is normatively solid but limited, recommending the strengthening of internal mechanisms, judicial independence, and increased diplomatic pressure to ensure state compliance.
