Extra-contractual Liability of the Ecuadorian State and violation of rights by public officials of educational institutions

The article presented is based on the analysis of the Extra-contractual Responsibility of the Ecuadorian State and the violation of citizens’ rights by public officials of educational institutions. A qualitative methodology was used, through descriptive research and the application of the legal exegetical method, which facilitated the bibliographic, doctrinal, legal and jurisprudential review. The results allowed us to understand that Ecuadorian regulations certainly establish the extra-contractual liability of the State, but unfortunately situations arise that promote the violation of the fundamental rights of citizens within the educational institutions of the State, which requires the strengthening of legal work, administrative and judicial that allow to make the guarantee of the rights of Ecuadorians effective.
