The rights of people in jail in the context of the Cuban constitutional reform

The protection of the rights of people in jail is a subject of great importance and relevance for the Juridical Sciences, especially in the context of Cuban constitutional reform. For that reason, the objective of this article is to argue the regulation of the rights of people in jail in the new Constitution of the Cuban Republic, who was approved in February, 2019. It were used methods such as the juridical-doctrinal and the legal comparison. The study established the main novel bases of the reform: the recognition of the category of “people in jail”, the regulation of habeas corpus as a procedure and the guarantees for a due process. Nevertheless, the main challenge is the expressed recognition of the rights of people in jail in the constitutional text.
