Orality, immediacy, concentration, and procedural economy as foundations of the preliminary hearing in paraguayan ordinary civil procedure

The objective of this study was to analyze how the principles of orality, immediacy, concentration, and procedural economy justify the legal regulation of a preliminary hearing within the framework of ordinary Paraguayan civil procedure. A qualitative approach was adopted. The sample was selected using non-probability convenience sampling and consisted of 29 judges of the Civil and Commercial Courts of First Instance and 1 Justice of the Civil and Commercial Chamber of the Supreme Court of Justice, totaling 30 magistrates. Data collection involved semi-structured interviews and document analysis, with theoretical sampling also used to identify relevant sources related to the preliminary hearing. Data analysis was performed using Atlas.ti version 9 software, through segmentation, coding, and interpretation of the information units. The results indicate that the principles of orality, judicial immediacy, concentration, and procedural economy are realized during the preliminary hearing. It is argued that the legal regulation of the preliminary hearing in Paraguayan ordinary civil proceedings is legally justifiable and procedurally convenient, provided that its normative design guarantees proper judicial management, the early resolution of disputes, and the optimization of procedural timelines through the effective implementation of the principles established as a guarantee of due process.Keywords: Preliminary hearing, ordinary civil proceedings, orality, immediacy, procedural economy, Paraguay.
